1. General terms of use of the site and the services offered

Use of the Paris en Images site implies full and total acceptance of the general terms described below. Those terms are subject to modifications or additions at any time; users of the Paris en Images site are therefore kindly requested to check them on a regular basis.

 

2. Presentation of the Paris en Images site

• • Site developed by the SAEML Parisienne de Photographie (a local semi-public company)
• • Photographs presented are from the Roger-Viollet, Carnavalet Museum, Historical Library of the City of Paris and Pierre Jahan collections (rights reserved, see general terms of use)
• • Use of software developed by France Télécom: downloading to mobile phones, 3D tour, TélénetCité.

3. General terms of use of the images

• The pictures shown on the Paris en Images site may be subject to literary and artistic property rights, industrial property rights, performing rights, rights of publicity, moral rights, property rights or any other right belonging to a third party.
• Their reproduction by Paris en Image users is authorised for private use only, to illustrate an educational or research project not commercialised in any form (for example, classes, lectures, theses).
• Their reproduction is also authorised for the illustration of personal non- commercial Internet sites.
• The photo credit must accompany each reproduction or representation of the photographic images. It must appear next to the image reproduced or in the illustration table created for that purpose by clearly indicating the page or place where the said image is reproduced.
• Any reproduction, representation, adaptation or modification of all or part of the pictures on the Paris en Images site for the purpose of public circulation (with the exception of the "educational" and “personal site” uses mentioned above) or for a commercial purpose, regardless of the means or process used, is prohibited.

4. Contractual limitations on the technical data

• The minimum configuration required for access to the Paris en Images experimental site is the following:
  Screen: 1,024 X 768
  Web browser: IE 5 and above (PC), Safari (Mac)
  The site also uses Flash and Shockwave technology.
• Site users agree to access the site by using hardware meeting the configuration standards described above and containing no virus(es).

5. Intellectual property

• Paris en Images is a registered trademark of the City of Paris. The Paris en Images logo is also protected by the same terms.
• The SAEML Parisienne de Photographie owns the intellectual property rights or the rights of usage for all the items accessible on the site, in particular the texts, images, graphics, icons and sounds.
• France Télécom owns the mobile phone download, 3D tour and TélénetCité software.
• Any unauthorised use of the site or of any item it contains will be considered an infringement of copyright and prosecuted in accordance with the measures in articles L.335-2 and following of the Intellectual Property Code.

 

6. Limitations of liability.

• The SAEML Parisienne de Photographie cannot be held liable for direct and indirect damage to the user’s hardware during the connection to the Paris en Images site and resulting either from the use of hardware that does not meet the specifications indicated in point 3, the appearance of a bug or an incompatibility.

 

7. Hypertext links and cookies

• The Paris en Images site contains hypertext links to other sites, installed with permission from the SAEML Parisienne de Photographie. However, the SAEML Parisienne de Photographie has no possibility of checking the content of the sites thus visited and consequently assumes no responsibility in this respect.
• Browsing the Paris en Images site is likely to cause the installation of cookie(s) on the user’s computer. A cookie is a small file which cannot be used to identify the user but which records information about a computer’s navigation through a site. The purpose of obtaining the data is to facilitate later navigation through the site and enable various measurements of the number of visits to the site.
• The refusal to have a cookie installed can make it impossible to access certain services. However, users can configure their computers in the following way to reject the installation of cookies:
  In Internet Explorer: Internet tools/options tab. Click on Confidentiality and choose Block all cookies. Submit by clicking on OK.

 

8. Applicable law and attribution of jurisdiction

• Any dispute or claim in relation to use of the Paris en Images site is subject to French law and the competent courts of Paris shall have exclusive jurisdiction.
